The NHPA will establish an opt-out option, meaning companies can only access your data with your consent. It also requires transparency in how companies use your information and gives you the right to opt out of sharing your data with third parties and penalties for not complying. Like the GDPR, this law prohibits discrimination towards consumers who have their privacy rights protected. For example businesses should not charge you more to protect your privacy, or provide discounts when they share your information with you.

Government Protection Law

Federal laws offer a variety of protection for the government, including:

Freedom of Information Act (FOIA) (44 U.S.C. The Freedom of Information Act (FOIA) provides you with the right to view records that are held by federal agencies. The Privacy Act of 1974 (5 U.S.C. 552) protects your privacy by establishing practices that govern the collection, maintenance and disclosure of personal data by federal agencies.

The New York State Personal Information Protection Law (Public Officers Law Article 6-A, sections 91-99), recognizes public concerns about privacy, and limits government collection, use and disclosure of personal information. It also prohibits the use of “secret files” by state agencies and forbids the release of personal information without your consent.

Whistleblowers play a critical role in keeping our government accountable and efficient. Federal law protects federal contractors, subcontractors, grantees and subgrantees against retaliation for reporting fraud, waste, or misuse in federal grants or contracts.
